Agency.Direct is operated by Only Good, LLC, a company based in Dallas, Texas ("Agency.Direct," "we," "our," or "us").

Agency.Direct is a marketplace platform that helps brands find and connect with agencies, and helps agencies discover and pitch on new project opportunities. This Privacy Policy explains how we collect, use, share, and protect information about you when you visit agency.direct or use any Agency.Direct services.

By using Agency.Direct, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use our services.

We collect information you provide directly, information generated by your use of the platform, and information from third-party services.

Account Information

When you create an account, we collect your name, email address, password or authentication credentials, company name, and your role (brand, agency, or admin).

Brand Information

If you use Agency.Direct as a brand, we collect your company profile, project details, services needed, budget range, timeline, contact information, company logos, and images you upload. We also collect messages and communications you send through the platform.

Agency Information

If you use Agency.Direct as an agency, we collect your agency profile, services offered, industries served, location, portfolio links, website, team size, budget range, logos, images, and pitches you submit.

Communication Data

We collect messages sent between brands and agencies through the platform, support requests, emails you send us, and chat content.

Payment and Business Data

We collect records related to success fees, invoices, payment status, and engagement reporting. If payments are processed through a third-party provider such as Stripe, that provider will collect payment details directly in accordance with their own privacy policy.

Usage Data

We automatically collect information about how you use the platform, including pages visited, features used, device type, browser type, IP address, operating system, referring URLs, time spent on pages, and similar technical data. We may use cookies, pixel tags, or analytics tools to collect this information.

We use the information we collect to:

• Operate, maintain, and improve the Agency.Direct marketplace
• Display brand projects to relevant agencies
• Display agency profiles to brands seeking services
• Enable agencies to submit pitches and brands to review them
• Enable messaging between brands and agencies
• Manage admin review, matching, approvals, and platform support
• Process success fees and other platform-related payments
• Investigate fraud, enforce our Terms of Use, and protect users
• Send service-related communications such as notifications and account updates
• Send marketing communications, with your ability to opt out at any time
• Analyze usage trends and improve the platform
• Comply with applicable laws and legal obligations

We do not sell your personal information. We may share information in the following circumstances:

Between Brands and Agencies

When a brand posts a project, project details may be visible to agencies using the platform. When an agency submits a pitch, pitch content and agency profile information are shared with the relevant brand. Messages between a brand and agency are visible to both parties.

Admin Access

Agency.Direct administrators may access platform data to provide support, review profiles and projects, perform matching, investigate disputes, enforce terms, process billing, and ensure platform safety.

Public Profiles and Directory

If your agency profile is set to "live" or your brand project is set to "live," that information may be visible to other users of the platform or the public, as described in Section 5 below.

Third-Party Service Providers

We share data with trusted third-party providers that help us operate the platform, including but not limited to: cloud hosting and database providers (e.g., Supabase), analytics tools, email delivery services, file storage providers, authentication services, and payment processors (e.g., Stripe). These providers process data on our behalf and are required to protect it appropriately.

Legal Requirements

We may disclose information if required by law, court order, or governmental authority, or if we believe disclosure is necessary to protect the rights, property, or safety of Agency.Direct, our users, or the public.

Business Transfers

In connection with a merger, acquisition, financing, or sale of assets, information we hold may be transferred as part of that transaction.

Agencies can choose whether their profile appears as "live" on Agency.Direct. When an agency profile is live, it may appear in the public agency directory and be visible to brands and visitors. Public agency profiles may include the agency name, logo, services offered, location, website, portfolio links, descriptions, and other profile details submitted by the agency.

Brands can choose whether their project is set to "live." Live projects may be visible to agencies on the platform. Brands control which details they include in their project listing.

If you want your profile or project removed from public visibility, you can turn off the live setting in your dashboard or contact us at hello@agency.direct.

We use cookies and similar tracking technologies to remember your preferences, keep you logged in, understand how the platform is used, and improve your experience. We may use first-party cookies as well as third-party analytics tools such as Google Analytics or similar services.

Most browsers allow you to control cookies through their settings. Disabling certain cookies may affect the functionality of Agency.Direct.

We implement reasonable administrative, technical, and physical security measures to protect your information from unauthorized access, use, disclosure, alteration, or destruction. Our platform uses industry-standard hosting and authentication providers designed with security in mind.

However, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee the absolute security of your data, and you use the platform at your own risk.

We retain your information for as long as your account is active or as needed to provide services, enforce our agreements, resolve disputes, comply with legal obligations, and support business operations. When information is no longer needed, we take reasonable steps to delete or anonymize it.

You may request access to, correction of, or deletion of your personal information by contacting us at hello@agency.direct. We will respond to requests within a reasonable time. Some information may need to be retained for legal or business purposes.

You may opt out of marketing emails by using the unsubscribe link in any marketing email we send. You may still receive service-related communications.

Depending on where you live, you may have certain rights regarding your personal information under applicable law, including:
